Q What is Diminution?

A It means that your car is worth less because it was in an accident. Most cars suffer a 10% to 50% loss in market value even after being repaired. Would you pay top dollar for a car that had been in an accident?

Q How do I get compensation for diminution in value?

A You may be entitled to compensation for diminution in value if:

  • Your accident was caused by someone other than you;
  • That person has insurance; and
  • Your car was properly repaired.

Q How much is my claim for diminution in value worth?

A The value of your claim is based on several factors:

A

  1. Take high-quality photographs of the damage to your vehicle. Take pictures that show the entire vehicle in a single frame, and close up pictures that show damage to the frame, body, undercarriage, and interior. Use a good camera with a flash. If you do not have a good camera, call me.
  2. Find your original purchase invoice for the vehicle, and save all receipts for the towing, storage, and repair of your vehicle.
  3. You are entitled to money for a rental car while your car is being repaired.

Case Studies

Audi A8 L Quattro – $11,571

This Audi A8 L Quattro had only 5,773 miles when it was in an accident which caused $30,411.51 in damages. The vehicle was worth about $103,000.00. The at-fault vehicle had a $50,000.00 property damage policy limit. The amount of the policy limit remaining after payment for the repairs and rental car was $11,571.83 which we were able to recover for our client for compensation for diminished value.

Land Rover Sport – $10,000 plus Personal Injury

This is a brand new Land Rover Sport that was rear-ended on I-4. Part of our investigation sometimes involves taking high quality photographs to prove the force of an impact and to prove how the accident occurred. Here, I took these pictures which proved to be invaluable in this case. The at-fault party only had $10,000 in property damage liability insurance which we did recover for our client. We were also successful in recovering more than $100,000 for our client’s injury claim.
